submitted 15 years ago by Pub. L. 111-350 to r/title-41-PUBLIC-CONTRACTS · 203 words · no verdicts yet
Contracts awarded without sealed bidding may use any contract type the agency head believes serves the Federal Government’s best interests. Such contracts generally must include a warranty against contingent-fee arrangements, with specified remedies and exceptions.
(a) Except as section 3905 provides, a contract awarded using procedures other than sealed bidding may be any type the agency head believes will best serve the Federal Government. (b)(1) Every such contract must include a suitable warranty, set by the agency head, that the contractor did not employ or retain a person or selling agency to obtain the contract under an agreement for a commission, percentage, brokerage, or contingent fee, except for bona fide employees or established commercial or selling agencies the contractor maintains to obtain business. (b)(2) If the warranty is breached or violated, the Government may cancel the contract without liability or deduct the full fee from the contract price or consideration. (b)(3) The warranty requirement does not apply to a contract at or below the simplified acquisition threshold or to a contract acquiring commercial products or services. This section does not define “simplified acquisition threshold.”
Except as provided in section 3905 of this title, contracts awarded after using procedures other than sealed-bid procedures may be of any type which in the opinion of the agency head will promote the best interests of the Federal Government.
Every contract awarded after using procedures other than sealed-bid procedures shall contain a suitable warranty, as determined by the agency head, by the contractor that no person or selling agency has been employed or retained to solicit or secure the contract on an agreement or understanding for a commission, percentage, brokerage, or contingent fee, except for bona fide employees or bona fide established commercial or selling agencies the contractor maintains to secure business.
For the breach or violation of the warranty, the Federal Government may annul the contract without liability or deduct from the contract price or consideration the full amount of the commission, percentage, brokerage, or contingent fee.
Paragraph (1) does not apply to a contract for an amount that is not greater than the simplified acquisition threshold or to a contract for the acquisition of commercial products or commercial services.
