When a federal agency wants to buy a product or service on the official procurement list, it generally must buy it from a qualifying blind or severely disabled workers' nonprofit, at the Committee's set price, as long as it can be delivered on time. This rule does not apply to products that must instead come from Federal Prison Industries under a different law.
(a) In general. A federal entity that plans to buy a product or service on the procurement list described in section 8503 must buy it from a qualified nonprofit agency for the blind* or a qualified nonprofit agency for other severely disabled* people, following the Committee's regulations and at the price the Committee* sets — as long as the agency can deliver it within the time the entity needs.
(b) Exception. This section does not apply to buying a product that is available from an industry set up under chapter 307 of title 18, when section 4124 of title 18 requires that product to be bought from that industry instead.
An entity of the Federal Government* intending to procure a product or service on the procurement list referred to in section 8503 of this title shall procure the product or service from a qualified nonprofit agency for the blind* or a qualified nonprofit agency for other severely disabled* in accordance with regulations of the Committee* and at the price the Committee establishes if the product or service is available within the period required by the entity.
This section does not apply to the procurement of a product that is available from an industry established under chapter 307 of title 18 and that is required under section 4124 of title 18 to be procured from that industry.
