This section sets rules about Consideration of effect of acquisition of water rights. It states the duties, powers, conditions, procedures, and exceptions that apply to that subject.
The Secretary* must give full consideration to whether the development, construction, and operation of a repository* can require any purchase or other acquisition of water rights that will have a significant adverse effect on the present or future development of the area in which such repository is located. The Secretary must mitigate any such adverse effects to the maximum extent practicable.
