A public entity cannot exclude a qualified individual with a disability from its services, programs, or activities because of that disability. It also cannot deny that person the benefits of those services or otherwise discriminate against them.
This section is the core anti-discrimination rule for public entities, subject to the rest of this subchapter. A qualified individual with a disability* may not be excluded from a public entity's services, programs, or activities because of the disability*. That person also may not be denied the benefits of those services, programs, or activities because of the disability. And that person may not be discriminated against by the public entity* in any other way because of the disability.
Subject to the provisions of this subchapter, no qualified individual with a disability* shall, by reason of such disability*, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity*, or be subjected to discrimination by any such entity.
