42 U.S.C. § 12841 — Nonapplicability of certain requirements for small projects

Section 1701u's rules don't apply to certain small housing projects here. This covers State recipients or jurisdictions that got under $3 million last year. It only applies when the project assists 50 units or fewer.
Notwithstanding any other provision of law, the requirements of section 1701u of title 12, and any implementing regulations or guidance, shall not apply to an activity assisted under this subchapter that involves rehabilitation, construction, or other development of housing if—
the recipient of assistance under this subchapter is—
a State* recipient pursuant to section 12746 of this title; or
a participating jurisdiction that received a total allocation of less than $3,000,000 in the most recent fiscal year pursuant to section 12746 of this title; and
the total number of dwelling units assisted as a part of such activity is not more than 50.
