The Secretary may create alternative Convention procedures for adoptions by relatives. The Secretary may also waive applicable requirements case by case when consistent with the Convention, in the interests of justice or to prevent grave physical harm to a child; that power cannot be delegated.
(a) The Secretary* may by regulation create alternative procedures, consistent with the Convention*, for Convention adoptions by people related to the children by blood, marriage, or adoption.
(b) (1) Despite other provisions of this chapter, the Secretary may, consistently with the Convention and case by case, waive applicable chapter or regulation requirements in the interests of justice or to prevent grave physical harm to the child. (2) The Secretary may not delegate this waiver power.
To the extent consistent with the Convention*, the Secretary* may establish by regulation alternative procedures for the adoption of children by individuals related to them by blood, marriage, or adoption, in cases subject to the Convention.
Notwithstanding any other provision of this chapter, to the extent consistent with the Convention, the Secretary may, on a case-by-case basis, waive applicable requirements of this chapter or regulations issued under this chapter, in the interests of justice or to prevent grave physical harm to the child.
The authority provided by paragraph (1) may not be delegated.
