42 U.S.C. § 16093 — Fuel cell school buses

(a) Establishment. The Secretary of Energy must set up cooperative agreements: first, with private-sector fuel cell bus developers to build fuel cell-powered school buses; then, with at least two local governments that already use natural gas-powered school buses, working together with those developers, to test the fuel cell buses in real use. (b) Cost sharing. Non-federal partners must pay at least 20% of the cost for fuel infrastructure development, and at least 50% of the cost for testing the buses and for any other development work not related to fuel infrastructure. (c) Reports to Congress. Within 3 years of August 8, 2005, the Secretary had to send Congress a report evaluating how well natural gas fueling infrastructure can be converted for fuel cell buses, and assessing the results of the whole development-and-testing program. (d) Authorization of appropriations. Congress authorized $25,000,000 total for the Secretary to use across fiscal years 2006 through 2009.
