42 U.S.C. § 1711 — Definitions

For this chapter: (a) “Secretary” means the Secretary of Labor. This section does not otherwise define the quoted term. (b) “War-risk hazard” means a hazard arising during a war involving the United States; an armed conflict involving it whether or not war is declared; or a war or armed conflict between military forces of any origin in a country where a person covered by this chapter is serving, when the hazard comes from (1) a missile, including liquid or gas, or a weapon, explosive, or other harmful thing used by a hostile force or person, or used against an attack or imagined attack by one; (2) a hostile force or person’s action, including rebellion or insurrection against the United States or its Allies; (3) discharge or explosion of munitions intended for war or armed conflict, except for employees of a munition manufacturer, processor, or transporter during manufacture, processing, or transport, or while the munitions are stored on that employer’s premises; (4) convoy-vessel collision or operating vessels or aircraft without running lights or other customary peacetime navigation aids; or (5) operating vessels or aircraft in a hostile zone or in war activities. (c) “Hostile force or person” means a nation, a subject of a foreign nation, or another person serving a foreign nation that (1) is at war with the United States or its allies, (2) is in armed conflict with them whether or not war is declared, or (3) is involved in a war or armed conflict between military forces of any origin in a country where a person covered by this chapter serves. (d) “Allies” means a nation with which the United States shares a military effort or has a common defensive military alliance. (e) “War activities” includes activities directly related to military operations. (f) “Continental United States” means the States and the District of Columbia.
