submitted 8 years ago by Pub. L. 115-246 to r/title-42-THE-PUBLIC-HEALTH-AND-WELFARE · 71 words · no verdicts yet
The Secretary of Energy must make sure laboratory contractors don't charge general overhead costs to laboratory-directed research and development funds. This rule doesn't apply to national security laboratories, which are covered by a separate 2017 defense law provision instead.
(a) In general — Unless the exception in subsection (b) applies, the Secretary* must make sure that the companies operating Department* of Energy laboratories do not charge the cost of their own general and administrative overhead to money set aside for laboratory-directed research and development.
(b) Exception for national security laboratories — This rule does not apply to national security laboratories. Those laboratories are instead covered by section 3119 of the National Defense Authorization Act for Fiscal Year 2017 (Public Law 114–328).
Except as provided in subsection (b), the Secretary* shall ensure that laboratory operating contractors do not allocate costs of general and administrative overhead to laboratory directed research and development.
This section shall not apply to the national security laboratories with respect to which section 3119 1 of the National Defense Authorization Act for Fiscal Year 2017 (Public Law 114–328) applies.
