The Director must run a program to fix up Office of Science laboratory infrastructure. It covers renovating, replacing, and modernizing facilities and utility systems. It authorizes $550 million per year through 2027.
(a) In general. The Director* must run a program to make infrastructure at Office of Science laboratories safer, more efficient, and better able to support their missions.
(b) Inclusions. The program must include projects to: (1) renovate or replace space that no longer meets research needs; (2) replace facilities that cost more to keep operating than to replace; (3) modernize utility systems to prevent failures and improve efficiency; (4) remove excess facilities to allow safe, efficient operations; and (5) build modern facilities for advanced research that needs controlled environmental conditions.
(c) Approach. The Director must use whatever appropriate methods the Secretary* decides fit, including: (1) capital line items; (2) minor construction projects; (3) energy savings performance contracts; (4) utility energy service contracts; (5) alternative financing; and (6) expense funding.
(d) Submission to Congress. Each year through fiscal year 2027, at the same time as the President's budget, the Secretary must send the relevant House and Senate Appropriations and authorizing committees a list of the projects to be funded, describing each project* and its funding plan.
(e) Authorization of appropriations. Out of Office of Science funds, $550,000,000 is authorized for each of fiscal years 2023 through 2027.
The Director* shall carry out a program to improve the safety, efficiency, and mission readiness of infrastructure at laboratories of the Office of Science.
The program under subsection (a) shall include projects—
to renovate or replace space that does not meet research needs;
to replace facilities that are no longer cost effective to renovate or operate;
to modernize utility systems to prevent failures and ensure efficiency;
to remove excess facilities to allow safe and efficient operations; and
to construct modern facilities to conduct advanced research in controlled environmental conditions.
In carrying out the program under subsection (a), the Director shall use all available approaches and mechanisms, as the Secretary* determines to be appropriate, including—
capital line items;
minor construction projects;
energy savings performance contracts;
utility energy service contracts;
alternative financing; and
expense funding.
For each fiscal year through fiscal year 2027, at the same time as the annual budget submission of the President, the Secretary shall submit to the Committee on Appropriations and the Committee on Energy and Natural Resources of the Senate and the Committee on Appropriations and the Committee on Science, Space, and Technology of the House of Representatives a list of projects for which the Secretary will provide funding under this section, including a description of each project* and the funding profile for the project.
Out of funds authorized to be appropriated for the Office of Science in a fiscal year, there is authorized to be appropriated to the Secretary to carry out the activities described in this section $550,000,000 for each of fiscal years 2023 through 2027.
