Scientific or engineering research contracts under this chapter must explain how inventions will be handled in a way that protects the public interest and the other party’s fair interests. The Foundation may not make an arrangement that conflicts with patent law.
Every contract or other arrangement under this chapter concerning scientific or engineering research must include provisions governing inventions produced under it. The provisions must protect the public interest and the fair interests of the individual or organization entering the contract or arrangement. Nothing in this chapter authorizes an arrangement inconsistent with any law governing the issuing or use of patents.
Each contract or other arrangement executed pursuant to this chapter which relates to scientific or engineering research shall contain provisions governing the disposition of inventions produced thereunder in a manner calculated to protect the public interest and the equities of the individual or organization with which the contract or other arrangement is executed: Provided, however, That nothing in this chapter shall be construed to authorize the Foundation to enter into any contractual or other arrangement inconsistent with any provision of law affecting the issuance or use of patents.
