42 U.S.C. § 19134 — Advisory committee on engineering biology research and development

(a) In general — The agency co-chair of the interagency committee established under section 19133, consulting with OSTP, must designate or establish an advisory committee^* on engineering-biology research and development. The committee must have at least 12 members, including representatives of research and academic institutions, industry, and nongovernmental entities. The members must be qualified to advise on the Initiative^*. This section does not define “Initiative.”

(b) Assessment — The advisory committee must assess:

(1) the current state^* of United States competitiveness in engineering biology, including the scope and scale of United States investments in engineering-biology research and development in the international context;
(2) current United States market barriers to commercializing engineering-biology products, processes, and tools;
(3) progress in carrying out the Initiative;
(4) whether the Initiative needs revision;
(5) the balance of Initiative activities and funding;
(6) whether the strategic plan developed or updated by the committee under section 19133 is helping maintain United States leadership in engineering biology; and
(7) whether the Initiative adequately addresses ethical, legal, environmental, safety, security, and other appropriate societal issues.

(c) Reports — Beginning no later than two years after August 9, 2022, and at least once every five years after that, the advisory committee must submit to the President and the listed House and Senate committees a report on:

(1) its assessment findings under subsection (b); and
(2) its recommendations for ways to improve the Initiative.

(d) Application of Federal Advisory Committee Act — Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) does not apply to the advisory committee.

(e) Termination — The advisory committee ends 10 years after August 9, 2022.
