The NRC must identify disposal methods other than shallow land burial and publish licensing guidance and technical requirements for States or compacts pursuing those methods.

(a) Within 12 months after January 15, 1986, the NRC, consulting with the States and other interested persons, must identify low-level-waste disposal methods other than shallow land burial and establish and publish technical guidance about licensing facilities that use those methods. (b) Within 24 months after January 15, 1986, the Commission, consulting with the States and other interested persons, must identify and publish all relevant technical information about the methods identified under (a) that a State or compact must provide to the Commission to pursue those methods. It must publish that information together with the technical requirements that, in the Commission’s judgment, facilities must meet if they pursue those methods as an alternative to shallow land burial. The information and requirements must include, but need not be limited to, site suitability, site design, facility operation, disposal-site closure, and environmental monitoring needed to meet the Commission’s performance goals for a licensed low-level-radioactive-waste disposal facility. The Commission must specify and publish the requirements in the form and manner it considers appropriate.
