42 U.S.C. § 2136 — Classes of facilities

The Commission may group licensed production and utilization facilities by similar operating and technical characteristics. It may define the activities for each class and set the amount of special nuclear material available to each facility.
The Commission* may—
(a) group facilities licensed under section 2133 or 2134 into classes, including production facilities, utilization facilities, or both, based on similar operating and technical characteristics;
(b) define the activities to be carried out at each class of facility; and
(c) designate the amount of special nuclear material available for use by each facility.
The Commission* may—
group the facilities licensed either under section 2133 or 2134 of this title into classes which may include either production or utilization facilities or both, upon the basis of the similarity of operating and technical characteristics of the facilities;
define the various activities to be carried on at each such class of facility; and
designate the amounts of special nuclear material available for use by each such facility.
