42 U.S.C. § 214 — Presentation of United States flag upon retirement

When a Public Health Service officer retires from active duty, the Secretary of Health and Human Services must give them a U.S. flag. An officer can only get this flag once, even if some other law also provides one. The flag costs the officer nothing.
(a) Presentation of flag — When a commissioned officer of the Public Health Service* leaves active commissioned service because they are retiring, the Secretary* of Health and Human Services must present them with a United States flag.
(b) Multiple presentations not authorized — An officer cannot get a flag under this section if they already received one before, whether under this section or any other law that provides a flag for leaving active service to retire.
(c) No cost to recipient — The officer does not have to pay anything for the flag.
Upon the release of an officer of the commissioned corps of the Service* from active commissioned service for retirement, the Secretary* of Health and Human Services shall present a United States flag to the officer.
An officer is not eligible for presentation of a flag under subsection (a) if the officer has previously been presented a flag under this section or any other provision of law providing for the presentation of a United States flag incident to release from active service for retirement.
The presentation of a flag under this section shall be at no cost to the recipient.
