The Nuclear Regulatory Commission may license the Department of Energy to distribute specified nuclear materials using procedures for export licenses. Before distributing special nuclear or source material without an NRC export license, the Department must obtain State Department concurrence, consult specified agencies, and make required safety findings.

(a) The Nuclear Regulatory Commission may license the Department of Energy to distribute special nuclear material, source material, and byproduct material under sections 2074, 2094, and 2112, respectively, using the same procedures the law establishes for any person’s export license for that material. This section does not require the Department of Energy to obtain a license to distribute byproduct material under section 2112.

(b) The Department of Energy may not distribute special nuclear material or source material under section 2074 or 2094 except under an NRC export license until—
(1) it obtains the State Department’s concurrence and consults the NRC and Department of Defense under mutually agreed procedures established within no more than 90 days after March 10, 1978; and
(2) it reasonably judges, based on available assurances and information available to the United States Government, that the criteria in section 2156 or their equivalent and any applicable criteria in section 2157 are met, and that the proposed distribution would not harm the common defense and security.
