Each state's yearly allotment is whichever is bigger: a flat minimum amount, or a formula-based amount. The formula multiplies the total money Congress appropriated by the state's share of the nation's urban population. Puerto Rico, D.C., and the territories have their own flat minimums.

(a) Minimum allotment: Every state's allotment for a fiscal year is the greater of (1) a flat amount, $300,000 for each state, the District of Columbia, and Puerto Rico, and $50,000 for each of Guam, the Virgin Islands, American Samoa, and the Northern Mariana Islands, or (2) the formula amount from subsection (b). (b) Determination under formula: To find the formula amount, do two steps. First, take the total amount Congress appropriated under section 290cc–35(a) for the fiscal year. Second, multiply that by a percentage: the state's population living in urbanized areas, divided by the total U.S. population living in urbanized areas, using the Census Bureau's latest data.
