42 U.S.C. § 300d–44 — General provisions

Trauma centers must apply as the Secretary requires to get grants, which are capped at $2 million per year and per-center. Emergency awards last three years, extendable by one more, and getting one grant does not block a center from getting others. Of total funding, 70% funds uncompensated-care awards, 20% core mission awards, and 10% emergency awards, with uncompensated-care funds split 50/35/15 across categories A, B, and C.
(a) Application
A trauma center can only get a grant under section 300d–41(a) by submitting an application in the form, manner, and with the agreements, assurances, and information the Secretary* decides are needed.
(b) Limitation on duration of support
A center can receive emergency-award payments under section 300d–41(a)(3) for 3 fiscal years, but the Secretary may waive that and allow 1 more year.
(c) Limitation on amount of grant
Despite the percentages in section 300d–42(a), no grant under section 300d–41 may exceed $2,000,000 in a fiscal year.
(d) Eligibility
Except as limited by section 300d–42(b)(1)(B)(iii), getting or qualifying for one grant does not stop a trauma center from also qualifying for the other grants under section 300d–41.
(e) Funding distribution
Of the total amount appropriated under section 300d–45 for a year: 70 percent funds uncompensated-care awards, 20 percent funds core mission awards, and 10 percent funds emergency awards.
(f) Minimum allowance
If the amount appropriated under section 300d–45 for a year is less than $25,000,000, all of it must go to uncompensated-care awards instead of following subsection (e).
(g) Uncompensated care award distribution
Despite section 300d–42(a), of the money appropriated for uncompensated-care grants, the Secretary must: (1) set aside 50 percent for Category A centers, 35 percent for Category B centers, and 15 percent for Category C centers; and (2) within each category, give out the funds in proportion to each center's award level as set under section 300d–42(a)(2).
(h) Report
Starting two years after March 23, 2010, and every two years after that, the Secretary must report to Congress on the status of grants under section 300d–41 and the overall financial stability of trauma centers.
The Secretary* may not award a grant to a trauma center under section 300d–41(a) of this title unless such center submits an application for the grant to the Secretary and the application is in such form, is made in such manner, and contains such agreements, assurances, and information as the Secretary determines to be necessary to carry out this part.
The period during which a trauma center receives payments under a grant under section 300d–41(a)(3) of this title shall be for 3 fiscal years, except that the Secretary may waive such requirement for a center and authorize such center to receive such payments for 1 additional fiscal year.
Notwithstanding section 300d–42(a) of this title, a grant under section 300d–41 of this title may not be made in an amount exceeding $2,000,000 for each fiscal year.
Except as provided in section 300d–42(b)(1)(B)(iii) of this title, acquisition of, or eligibility for, a grant under section 300d–41(a) of this title shall not preclude a trauma center from being eligible for other grants described in such section.
Of the total amount appropriated for a fiscal year under section 300d–45 of this title, 70 percent shall be used for substantial uncompensated care awards under section 300d–41(a)(1) of this title, 20 percent shall be used for core mission awards under section 300d–41(a)(2) of this title, and 10 percent shall be used for emergency awards under section 300d–41(a)(3) of this title.
Notwithstanding subsection (e), if the amount appropriated for a fiscal year under section 300d–45 of this title is less than $25,000,000, all available funding for such fiscal year shall be used for substantial uncompensated care awards under section 300d–41(a)(1) of this title.
Notwithstanding section 300d–42(a) of this title, of the amount appropriated for substantial uncompensated care grants for a fiscal year, the Secretary shall—
make available—
50 percent of such funds for category A trauma center grantees;
35 percent of such funds for category B trauma center grantees; and
15 percent of such funds for category C trauma center grantees; and
provide available funds within each category in a manner proportional to the award basis specified in section 300d–42(a)(2) of this title to each eligible trauma center.
Beginning 2 years after March 23, 2010, and every 2 years thereafter, the Secretary shall biennially report to Congress regarding the status of the grants made under section 300d–41 of this title and on the overall financial stability of trauma centers.
