42 U.S.C. § 300ee–13 — Requirement of submission of application containing certain agreements and assurances

(a) In general The Secretary can't pay a state under section 300ee-11(a) for a fiscal year unless all of these happen: (1) The state gives the Secretary a description of what it plans to spend the money on that year. (2) That description names the populations, areas, and localities in the state that need the services this part funds. (3) The description explains the programs, activities, and services planned, including how they'll be coordinated with similar public and private programs. (4) The state submits an application for the payments, containing the agreements this part requires. (5) The state's chief executive officer certifies those agreements. (6) The application gives assurances of compliance that satisfy the Secretary. (7) The application is in whatever form, made in whatever manner, and contains whatever other agreements, assurances, and information the Secretary decides are necessary to carry out this part. (b) Opportunity for public comment The Secretary also can't pay a state unless the state agrees that, while preparing the description required in subsection (a), it will give public notice of the description (including any changes) and let interested people comment on it.
