States can use grant money to help low-income HIV/AIDS patients keep health insurance or get benefits through insurance programs, including risk pools. This money can't fund the creation or running of a risk pool itself, only individual premiums. It also can't be used for anything a state already pays for through Medicaid.

(a) In general. A state may use section 300ff–21 grant money to set up a financial-assistance program (under section 300ff–22(b)(3)(F)) that helps eligible low-income people with HIV/AIDS either: (1) keep continuous health insurance; or (2) get medical benefits through a health insurance program, including risk pools. (b) Limitations. This assistance may not be used: (1) to pay for creating, funding, or running a liability risk pool itself -- except that it can still cover an individual's premium contributions into an existing risk pool; or (2) to pay for anything a state already spends money on under Medicaid (title XIX of the Social Security Act).
