42 U.S.C. § 300gg–63 — General exceptions

(a) Exception for certain benefits: This part's requirements don't apply to health coverage when it comes to providing the excepted benefits described in section 300gg–91(c)(1) — for example, accident or disability-income insurance, liability insurance, workers' compensation, and other coverage where medical benefits are secondary or incidental to something else. (b) Exception for certain benefits if certain conditions met: This part's requirements also don't apply to health coverage when it comes to providing the excepted benefits described in section 300gg–91(c)(2), (3), or (4) — such as limited-scope dental or vision benefits, long-term care benefits, disease-specific coverage, or Medicare supplemental coverage — but only if those benefits are provided under a separate policy, certificate, or contract of insurance.
