42 U.S.C. § 300h–9 — Secure geologic storage permitting

(a) Definitions. In this section, "Administrator" means the EPA Administrator, and "Class VI well" means a well described in 40 CFR 144.6(f) (or whatever regulation replaces it). (b) Authorization of appropriations for geologic sequestration permitting. Congress may spend $5,000,000 each year from fiscal year 2022 through 2026 for the Administrator to permit Class VI wells that inject carbon dioxide for geologic sequestration, following the Safe Drinking Water Act and EPA's final rule on Class VI wells (75 Fed. Reg. 77230, December 10, 2010). (c) State permitting program grants. (1) Establishment. The Administrator must award grants to states that get approval, under Safe Drinking Water Act section 1422 (42 U.S.C. 300h–1), to run their own underground injection control program for permitting Class VI carbon dioxide wells. (2) Use of funds. A state that gets this grant must use it to cover the costs of setting up and running that state program. (3) Authorization of appropriations. Congress may spend $50,000,000 total for fiscal years 2022 through 2026 for these grants.
