42 U.S.C. § 300mm–1 — WTC Health Program Scientific/Technical Advisory Committee; WTC Health Program Steering Committees

(a) Advisory Committee: (1) Establishment — the WTC Program Administrator must set up the WTC Health Program Scientific/Technical Advisory Committee to review scientific and medical evidence and recommend new eligibility rules and new WTC-related health conditions to the Administrator. (2) Composition — the Administrator appoints the members and must include at least: (A) 4 occupational physicians, at least 2 with experience treating WTC rescue and recovery workers; (B) 1 physician who specializes in pulmonary medicine; (C) 2 environmental medicine or environmental health specialists; (D) 2 representatives of WTC responders; (E) 2 representatives of certified-eligible WTC survivors; (F) an industrial hygienist; (G) a toxicologist; (H) an epidemiologist; and (I) a mental health professional. (3) Meetings — the Committee meets as often as its work requires. (4) Reports — the Administrator must publish the Committee's recommendations on the WTC Program's public website. (5) Duration — no matter what any other law says, the Committee keeps operating as long as the WTC Program is running. (6) Application of chapter 10 of title 5 — unless a specific rule says otherwise, the Federal Advisory Committee Act (title 5, chapter 10) applies to this Committee. (b) WTC Health Program Steering Committees: (1) Consultation — the Administrator must consult with two Steering Committees: (A) the WTC Responders Steering Committee, which gathers input from affected stakeholders and helps coordinate monitoring and treatment programs for enrolled responders under subpart 1 of part B; and (B) the WTC Survivors Steering Committee, which does the same job for initial health evaluations, monitoring, and treatment for screening-eligible and certified-eligible survivors under subpart 2 of part B. (2) Membership — (A) the Responders Steering Committee: (i) must include representatives of the Centers of Excellence that serve responders; representatives of labor organizations for firefighters, police, other New York City employees, and recovery and cleanup workers who responded to 9/11; and 3 New York City representatives, one chosen by the police commissioner, one by the health commissioner, and one by the mayor. (ii) It started out made up of the members of the prior WTC Monitoring and Treatment Program Steering Committee, as that committee existed the day before January 2, 2011. (B) The Survivors Steering Committee: (i) must include representatives of the Centers of Excellence that serve survivors; the population of residents, students, and area or other workers affected by 9/11; screening-eligible and certified-eligible survivors and the organizations that advocate for them; and New York City. (ii) It started out made up of the members of the prior WTC Environmental Health Center Survivor Advisory Committee, as it existed the day before January 2, 2011. (C) Additional appointments — each Steering Committee can add more members if a majority of its voting members agree. (D) Vacancies — an open seat is filled by someone the Steering Committee recommends.
