42 U.S.C. § 300u–6a — Individual offices of minority health within the Department

(a) In general: The head of each agency named in subsection (b) must set up an "Office of Minority Health" inside that agency. The agency head appoints that office's director, who reports directly to the agency head. The agency head carries out this section, as it applies to that agency, through that director. (b) Specified agencies: The agencies covered are the Centers for Disease Control and Prevention, the Health Resources and Services Administration, the Substance Abuse and Mental Health Services Administration, the Agency for Healthcare Research and Quality, the Food and Drug Administration, and the Centers for Medicare & Medicaid Services. (c) Director; appointment: Each of these Offices of Minority Health must be led by a director with documented experience and expertise in minority health services research and eliminating health disparities. (d) References: Unless a law says otherwise, any federal-law reference to "the Office of Minority Health" within the Department of Health and Human Services means the Office of Minority Health in the Office of the Secretary — not one of these agency-level offices. (e) Funding: (1) Allocations: Out of the money appropriated to each specified agency each year, the Secretary must set aside an appropriate amount to fund that agency's minority health office. To free up that amount, the Secretary must cut, by roughly the same percentage, the funding otherwise available to each of that agency's programs. (2) Availability of funds for staffing: A minority health office may spend its funds on staffing costs.
