42 U.S.C. § 3058ee — Audits

This section gives specified officials access to records needed to audit financial assistance under this subchapter. It limits the information that State and area aging agencies may request from service providers.
(a) Access. The Assistant Secretary*, the Comptroller General of the United States, and their properly authorized representatives may inspect books, documents, papers, and records that relate to financial assistance received under this subchapter, for an audit or examination.
(b) Limitation. State* agencies and area agencies on aging may not ask providers for information or data unless it relates to services provided under this subchapter or to payment for those services.
The Assistant Secretary*, the Comptroller General of the United States, and any duly authorized representative of the Assistant Secretary* or the Comptroller shall have access, for the purpose of conducting an audit or examination, to any books, documents, papers, and records that are pertinent to financial assistance received under this subchapter.
State* agencies and area agencies on aging shall not request information or data from providers that is not pertinent to services furnished under this subchapter or to a payment made for the services.
