Congress consents to at least three neighboring States forming interstate compacts to create regional infrastructure development agencies. Those agencies may facilitate covered-project reviews and have the authority and duties of State agencies.
(a) Interstate compacts. Congress consents to three or more contiguous States entering an interstate compact under State* law, or under delegated permitting authority under section 4370m–5, to create regional infrastructure development agencies. The agencies must facilitate covered-project* authorization* and review that advances infrastructure development, production, and generation in the compacting States.
(b) Regional infrastructure agencies. For this subchapter, such an agency* has the same authority and responsibilities as a State agency.
The consent of Congress is given for 3 or more contiguous States to enter into an interstate compact establishing regional infrastructure development agencies to facilitate authorization* and review of covered projects, under State* law or in the exercise of delegated permitting authority described under section 4370m–5 of this title, that will advance infrastructure development, production, and generation within the States that are parties to the compact.
For the purpose of this subchapter, a regional infrastructure development agency* referred to in subsection (a) shall have the same authorities and responsibilities of a State agency.
