This section appropriates $10 billion for fiscal year 2021 for critical capital projects that directly enable work, education, or health monitoring, including remote options, in response to the COVID-19 public health emergency. It sets minimum payments, a population-based formula for the remaining money, and the application deadline.

(a) Appropriation. The Treasury must provide $10 billion for fiscal year 2021, in addition to other available money. The money remains available until it is spent. It is for payments to States, territories, and Tribal governments for critical capital projects that directly enable work, education, and health monitoring, including remote options, in response to the COVID-19 public health emergency.

(b) Payments. (1) Minimum amounts. From this money—(A) the Secretary must pay $100 million to each State; (B) the Secretary must pay $100 million in equal shares to the United States Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, the Marshall Islands, Micronesia, and Palau; and (C) the Secretary must pay $100 million in equal shares to Tribal governments and Hawaii, in addition to Hawaii’s payment under subparagraph (A). At least $50,000 must go to each Tribal government. Hawaii must receive at least $50,000 and no more than $200,000 for the exclusive use of its Department of Hawaiian Home Lands and Native Hawaiian Education Programs to assist Native Hawaiians under this section.

(2) Remaining amounts. After those minimum payments, the Secretary must pay the remaining money to States as follows: 50 percent according to each State’s share of the population of all States; 25 percent according to each State’s share of people living in rural areas in all States; and 25 percent according to each State’s share of people whose household income is below 150 percent of the poverty line for a family of the relevant size. The Treasury Secretary must use the most recent available Census Bureau data.

(c) Timing. Within 60 days after March 11, 2021, the Secretary must establish a grant-application process for accessing the funding under subsection (b).

(d) Definitions. (1) “Secretary” means the Secretary of the Treasury. (2) “State” means each of the 50 States, the District of Columbia, and Puerto Rico. (3) “Tribal government” has the meaning given in section 802(g) of this title; this section does not define that term.
