42 U.S.C. § 8235g — Records and reports

(a) Records: Every state or local government that submits an application for a plan approved under section 8235a(a), and every public utility and contractor entering a contract under such a plan, must keep records and make reports as the Secretary requires. The Secretary and the Comptroller General of the United States must be allowed reasonable access, at reasonable times, to the books, documents, papers, records, and reports of each of these governments, utilities, and contractors, whenever the Secretary — after consulting the Comptroller General — decides the material is relevant to this part. (b) Reports: The Secretary must send the President an annual report on the activities carried out under this part. This report goes to Congress along with the Department of Energy's annual report required under section 7267. It must contain: (1) an estimate of the total energy saved by activities under this part; (2) an estimate of the annual energy savings expected from each prototype program set up under an approved plan; (3) an analysis, developed with the Federal Trade Commission and the Department of Justice, of each prototype program's impact on competition; and (4) if the Secretary decides it's appropriate, an analysis of what would happen if plan approval were expanded nationwide, along with an assessment of the different ways that expansion could be done.
