The Secretary of Energy runs the solar power program. The Secretary must work with the Secretary of Defense to avoid interfering with defense activities, set rules to track how the systems perform, and report to Congress every year. Normal public rulemaking notice rules do not apply.

This section puts the Secretary of Energy in charge of running the program created by section 8272 of this title. The Secretary must do three things: (1) Consult with the Secretary of Defense to make sure installing and buying photovoltaic solar electric systems under this part does not interfere with defense-related activities. (2) Set requirements to monitor and assess how the installed photovoltaic electric systems perform and operate. (3) Report to Congress every year on the status of the program. The section also says that, no matter what any other law requires, the Secretary does not have to follow the notice-and-comment rulemaking requirements in section 553 of title 5 when carrying out these duties under this part.
