43 U.S.C. § 1528 — Authorization of appropriations

submitted 58 years ago by Pub. L. 90-537 to r/title-43-PUBLIC-LANDS · 249 words · no verdicts yet

in plain englishAI-generated · not legal advice

This section authorizes amounts for Central Arizona Project construction, operation, and maintenance, and separately authorizes non-Indian distribution and drainage facilities with a 20-percent non-Federal contribution.

(a) Congress authorizes appropriations for Central Arizona Project construction, including prepayment for power-generation and transmission facilities but excluding distribution and drainage facilities for non-Indian land, of $832,180,000, plus or minus amounts justified by ordinary construction-cost changes shown by applicable engineering cost indexes. It also authorizes sums needed to operate and maintain the project.
(b) Congress also authorizes $100,000,000 for distribution and drainage facilities for non-Indian land, plus or minus amounts justified by ordinary cost changes shown by engineering and cost indexes from September 30, 1968. The Secretary must make agreements requiring non-Federal interests to provide at least 20 percent of the total facility cost during construction. Despite section 1543, these appropriations and facility-operation revenues may not be credited to the Lower Colorado River Basin Development Fund, and that fund may not pay the Treasury’s general fund to return any construction, operation, or maintenance costs for these facilities.
