An applicant seeking Federal approval for a project involving a right-of-way across public or National Forest System lands must apply to the responsible Secretary at the same time and provide the same information.
An applicant before a Federal department or agency other than Interior or Agriculture who seeks a license, certificate, or other authority for a project involving a right-of-way over, on, under, or through public land or National Forest System land must simultaneously apply to the responsible Secretary for authority to use that land and must give the Secretary all information supplied to the other Federal department or agency.
Applicants before Federal departments and agencies other than the Department of the Interior or Agriculture seeking a license, certificate, or other authority for a project which involve a right-of-way over, upon, under, or through public land or National Forest System lands must simultaneously apply to the Secretary concerned for the appropriate authority to use public lands or National Forest System lands and submit to the Secretary concerned all information furnished to the other Federal department or agency.
