The non-Federal borrower must pay all operating, maintenance, and replacement costs for a federally assisted project. At the borrower’s request, the Secretary may help create a plan for setting beneficiary rates and fees.
(a) In general. The non-Federal share of a project’s operating, maintenance, and replacement costs is 100 percent if the project* receives Federal assistance under this subchapter.
(b) Plan. If the non-Federal borrower* asks, the Secretary* may help develop an operating, maintenance, and replacement plan. The plan provides a framework to help the borrower establish rates and fees for project beneficiaries.
The non-Federal share of operations, maintenance, and replacement costs for a project* receiving Federal assistance under this subchapter shall be 100 percent.
On request of the non-Federal borrower*, the Secretary* may assist in the development of an operation, maintenance, and replacement plan to provide the necessary framework to assist the non-Federal borrower in establishing rates and fees for project beneficiaries.
