43 U.S.C. § 390h–34 — North Bay Water Reuse Program
submitted 17 years ago by Pub. L. 102-575 to r/title-43-PUBLIC-LANDS · 555 words · no verdicts yet
Sets up the North Bay Water Reuse Program, letting the Secretary sign cooperative agreements with California and North San Pablo Bay agencies to build water reclamation and reuse projects in two phases, sharing costs and authorizing $25,000,000 for the first phase.
(a) Definitions: (1) "Eligible entity" means a member agency of the North Bay Water Reuse Authority located in the North San Pablo Bay watershed, in Marin, Napa, Solano, or Sonoma County. (2) "Water reclamation and reuse project" means a project the Secretary and an eligible entity carry out in the watershed relating to water quality improvement, wastewater treatment, water reclamation and reuse, groundwater recharge and protection, surface water augmentation, or other related improvements. (3) "State" means California.
(b) North Bay Water Reuse Program: (1) In general: If the Secretary finds a project feasible, the Secretary — acting through a cooperative agreement with California or one of its subdivisions — may sign cooperative agreements with eligible entities to plan, design, and build water reclamation and reuse facilities and recycled water conveyance and distribution systems. (2) Coordination with other federal agencies: The Secretary and the eligible entity must, as much as practical, use design work and environmental evaluations already started by non-federal entities and by the Army Corps of Engineers in the watershed. (3) Phased project: A cooperative agreement must require the program to have two phases: (A) First phase — the Secretary and an eligible entity complete planning, design, and construction of the main treatment and main conveyance systems. (B) Second phase — the Secretary and an eligible entity complete planning, design, and construction of the sub-regional distribution systems. (4) Cost sharing: (A) Federal share — the federal share of the first phase's cost cannot exceed 25 percent of the total. (B) Form of non-federal share — the non-federal share may be in-kind services the Secretary decides would substantially help finish the project, including reasonable costs the eligible entity spent on planning, design, and construction, and the cost of land the entity acquired and owns that is used for and directly tied to the project. (C) Limitation — the Secretary may not fund the project's operation and maintenance. (5) Effect: Nothing in this section (A) affects or overrides state water law or an interstate water-allocation compact, or (B) gives any non-federal entity a federal right to a stream's water or any groundwater resource. (6) Authorization of appropriations: Congress may appropriate $25,000,000 for the federal share of the first phase's total cost, available until spent.
In this section:

surface water augmentation; or
other related improvements.
The term “State” means the State of California.
Contingent upon a finding of feasibility, the Secretary, acting through a cooperative agreement with the State or a subdivision of the State, is authorized to enter into cooperative agreements with eligible entities for the planning, design, and construction of water reclamation and reuse facilities and recycled water conveyance and distribution systems.
In carrying out this section, the Secretary and the eligible entity shall, to the maximum extent practicable, use the design work and environmental evaluations initiated by—
non-Federal entities; and
the Corps of Engineers in the San Pablo Bay Watershed of the State.
A cooperative agreement described in paragraph (1) shall require that the North Bay Water Reuse Program carried out under this section shall consist of 2 phases as follows:
During the first phase, the Secretary and an eligible entity shall complete the planning, design, and construction of the main treatment and main conveyance systems.
During the second phase, the Secretary and an eligible entity shall complete the planning, design, and construction of the sub-regional distribution systems.
The Federal share of the cost of the first phase of the project authorized by this section shall not exceed 25 percent of the total cost of the first phase of the project.
The non-Federal share may be in the form of any in-kind services that the Secretary determines would contribute substantially toward the completion of the water reclamation and reuse project, including—
reasonable costs incurred by the eligible entity relating to the planning, design, and construction of the water reclamation and reuse project; and
the acquisition costs of land acquired for the project that is—
used for planning, design, and construction of the water reclamation and reuse project facilities; and
owned by an eligible entity and directly related to the project.
The Secretary shall not provide funds for the operation and maintenance of the project authorized by this section.
Nothing in this section—
affects or preempts—
State water law; or
an interstate compact relating to the allocation of water; or
confers on any non-Federal entity the ability to exercise any Federal right to—
the water of a stream; or
any groundwater resource.
There is authorized to be appropriated for the Federal share of the total cost of the first phase of the project authorized by this section $25,000,000, to remain available until expended.
