43 U.S.C. § 898 — Rights of purchasers from railroads of coterminous lands not within grants
submitted 139 years ago by ch. 376 to r/title-43-PUBLIC-LANDS · 264 words · no verdicts yet
A bona fide purchaser may obtain a patent for certain numbered lands adjoining constructed parts of a railroad if the railroad company sold the lands as part of its grant, the lands were not conveyed to or for the company's use, and the lands were excepted for any reason from the grant's operation. The section excludes lands occupied by certain adverse claimants and lands settled after December 1, 1882, under specified conditions.
If a company sold to a United States citizen, or to someone who declared an intention to become a citizen, numbered sections of land as part of its grant, and those sections adjoin constructed parts of the railroad, were not conveyed to or for the company's use, and were for any reason excepted from the operation of the grant to the company, the bona fide purchaser may pay the United States the ordinary Government price for similar land. After that payment, a patent must issue to the bona fide purchaser, the purchaser's heirs, or assigns.
This section does not apply to land that, when sold, was bona fide occupied by an adverse claimant under United States preemption or homestead laws, if that claimant has not voluntarily abandoned the claim and occupation. Those preemption and homestead claimants must be allowed to complete their proof and entries and receive patents.
This section also does not apply to land settled after December 1, 1882, by people claiming to enter it under United States settlement laws. For that land, the people making those claims are entitled to prove up and enter it as in other similar cases.
Where any said company shall have sold to citizens of the United States, or to persons who have declared their intention to become such citizens, as a part of its grant, lands not conveyed to or for the use of such company, said lands being the numbered sections prescribed in the grant, and being coterminous with the constructed parts of said road, and where the lands so sold are for any reason excepted from the operation of the grant to said company, it shall be lawful for the bona fide purchaser thereof from said company to make payment to the United States for said lands at the ordinary Government price for like lands, and thereupon patents shall issue therefor to the said bona fide purchaser, his heirs or assigns: Provided, That all lands shall be excepted from the provisions of this section which at the date of such sales were in the bona fide occupation of adverse claimants under the preemption or homestead laws of the United States, and whose claims and occupation have not since been voluntarily abandoned, as to which excepted lands the said preemption and homestead claimants shall be permitted to perfect their proofs and entries and receive patents therefor: Provided further, That this section shall not apply to lands settled upon subsequent to the 1st day of December, 1882, by persons claiming to enter the same under the settlement laws of the United States, as to which lands the parties claiming the same as aforesaid shall be entitled to prove up and enter as in other like cases.
