submitted 151 years ago by ch. 152 to r/title-43-PUBLIC-LANDS · 166 words · no verdicts yet

in plain englishAI-generated · not legal advice

A railroad seeking rights under these sections must file a road profile within 12 months after locating each 20-mile section, with a different trigger for unsurveyed land. If a section is not completed within five years, the rights for that section are forfeited.

A railroad seeking the benefits of 43 U.S.C. §§ 934–939 must, within 12 months after locating each 20-mile road section on surveyed land—or within 12 months after the United States surveys it on unsurveyed land—file a road profile with the designated land-office officer for the district. After the Interior Secretary approves it, the profile must be noted on that office’s plats, and later dispositions of land crossed by the right-of-way remain subject to it. If a road section is not completed within five years after its location, the granted rights are forfeited for that incomplete section.
