43 U.S.C. § 956 — Right of way for tramroads, canals, or reservoirs

The Secretary of the Interior may allow certain United States citizens or citizen groups to use rights-of-way through specified public lands for tramroads, canals, or reservoirs. The allowed area is limited to the occupied water and adjoining land, or to a 50-foot strip along a tramroad, and the users must engage in listed activities.
Under general regulations the Secretary of the Interior sets, the Secretary may allow a United States citizen or association of United States citizens to use a right-of-way through United States public lands. The land may not be within a national forest, park, military reservation, or Indian reservation.
The use may be for a tramroad, canal, or reservoir. For a canal or reservoir, it may cover the ground occupied by the water plus 50 feet on each side of its edge. For a tramroad, it may cover 50 feet on each side of its center line.
The citizen or association must be engaged in mining, quarrying, cutting timber, or manufacturing lumber, or must use the right-of-way to furnish water for domestic, public, or other beneficial uses. This section does not define “right-of-way,” “tramroad,” or “beneficial uses.”
The Secretary of the Interior is authorized and empowered, under general regulations to be fixed by him, to permit the use of the right of way through the public lands of the United States, not within the limits of any national forest, park, military or Indian reservation, for tramroads, canals, or reservoirs to the extent of the ground occupied by the water of the canals and reservoirs and fifty feet on each side of the marginal limits thereof, or fifty feet on each side of the center line of the tramroad, by any citizen or any association of citizens of the United States engaged in the business of mining or quarrying or of cutting timber and manufacturing lumber or for the purposes of furnishing water for domestic, public, and other beneficial uses.
