46 U.S.C. § 31111 — Claims by nationals of foreign countries

A citizen of a foreign country cannot sue under this chapter in most cases. There is one exception, called reciprocity. That country must let U.S. citizens sue in its own courts under similar circumstances.
This section limits lawsuits by foreign nationals. A national of a foreign country cannot bring a civil action under this chapter unless the court is satisfied of one specific fact: that the foreign national's own government, under similar circumstances, lets United States nationals sue in its courts. This is a reciprocity requirement — the foreign country has to offer Americans the same access to its courts before its own nationals can sue here under this chapter.
A national of a foreign country may not maintain a civil action under this chapter unless it appears to the satisfaction of the court in which the action is brought that the government of that country, in similar circumstances, allows nationals of the United States to sue in its courts.
