If someone ignores a Federal Maritime Commission subpoena or order, the Attorney General or an injured party can ask a federal court to enforce it. If the court finds the subpoena or order was properly issued, it must enforce it. A lawsuit to enforce an order must be filed within 3 years of the violation.
(a) Going to court. If a person does not comply with a Commission subpoena or order, the Attorney General — at the Commission's request — or an injured party may ask a federal district court with authority over the parties to enforce it. If, after a hearing, the court finds the subpoena or order was properly and duly issued, the court must enforce it.
(b) Deadline. A lawsuit to enforce a Commission order under this section must be filed within 3 years after the date the order was violated.
If a person does not comply with a subpoena or order of the Federal Maritime Commission, the Attorney General, at the request of the Commission, or an injured party, may seek enforcement in a district court of the United States having jurisdiction over the parties. If, after hearing, the court determines that the subpoena or order was regularly made and duly issued, the court shall enforce the subpoena or order.
An action under this section to enforce an order of the Commission must be brought within 3 years after the date the order was violated.
