The Secretary of Transportation may fill up to 20 unfilled critical positions at the Academy. These hires skip most of the usual federal hiring rules, but not all of them. A critical position is one that improves culture, student wellbeing, governance, or other priorities.
(a) In General. If a critical position at the Academy* stays unfilled, the Secretary of Transportation may appoint a qualified candidate without following most of the hiring rules in subchapter I of chapter 33 of title 5 -- except sections 3303 and 3328, which still apply. The Secretary can use this power for up to 20 such positions.
(b) Critical Position Defined. A "critical position" is one that helps improve (1) the Academy's culture or infrastructure, (2) student health and wellbeing, (3) Academy governance, or (4) any other priority area the Council identifies.
In the event of an unfilled vacancy for any critical position at the United States Merchant Marine Academy*, the Secretary of Transportation may appoint, without regard to the provisions of subchapter I of chapter 33 of title 5, other than sections 3303 and 3328 of that title, a qualified candidate for the purposes of filling up to 20 of such positions.
In this section, the term “critical position” means a position that contributes to the improvement of—
the culture or infrastructure of the Academy;
student health and well being;
Academy governance; or
any other priority areas identified by the Council.
