46 U.S.C. § 57110 — Salvage recoveries for subrogated ownership of vessels and cargoes
submitted 7 years ago by Pub. L. 116-92 to r/title-46-SHIPPING · 237 words · no verdicts yet
This law lets the Secretary of Transportation make salvage agreements to recover, sell, or dispose of sunken or damaged vessels, cargo, or property owned or insured by certain past and present maritime agencies. Net proceeds are split — half for maritime academy training-ship needs, and the rest for maritime heritage preservation grants.
(a) Salvage Agreements. The Secretary of Transportation may enter into marine salvage agreements to recover, sell, or dispose of sunken or damaged vessels, cargoes, or property that is owned or insured by, or on behalf of, the Maritime Administration, the United States Shipping Board, the U.S. Shipping Bureau, the United States Maritime Commission, or the War Shipping Administration.
(b) Military Craft. Before starting or allowing any salvage activity that would disturb a sunken military craft (as defined in a specific 2005 defense law), the Secretary of Transportation must first consult with the Secretary of the relevant military department.
(c) Recoveries. Regardless of any other law, the net proceeds from these salvage agreements stay available until spent, and get split this way: (1) Half goes to the Maritime Administrator, to pay or reimburse expenses for maintaining, repairing, and modernizing state* maritime academies or the U.S. Merchant Marine Academy's facilities and training ships, and for buying simulators and fuel. (2) The rest goes to the Department of the Interior, for maritime heritage preservation grants under a specific provision of title 54.
The Secretary of Transportation is authorized to enter into marine salvage agreements for the recoveries, sale, and disposal of sunken or damaged vessels, cargoes, or properties owned or insured by or on behalf of the Maritime Administration, the United States Shipping Board, the U.S. Shipping Bureau, the United States Maritime Commission, or the War Shipping Administration.
The Secretary of Transportation shall consult with the Secretary of the military department concerned prior to engaging in or authorizing any activity under subsection (a) that will disturb sunken military craft, as such term is defined in section 1408(3) of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (Public Law 108–375; 10 U.S.C. 113 note).
Notwithstanding any other provision of law, the net proceeds from salvage agreements entered into as authorized in subsection (a) shall remain available until expended and be distributed as follows:
Fifty percent shall be available to the Administrator of the Maritime Administration for the payment or reimbursement of expenses incurred by or on behalf of State* maritime academies or the United States Merchant Marine Academy for facility and training ship maintenance, repair, and modernization, and for the purchase of simulators and fuel.
The remainder shall be distributed for maritime heritage preservation to the Department of the Interior for grants as authorized by section 308703 of title 54.
