The Secretary of Transportation can build new vessels or fix up old ones to meet this law's goals. This work must happen at U.S. shipyards, though the Secretary may use navy yards if private bids fail. Contracts with private shipbuilders follow the same rules as Merchant Marine Act contracts.
(a) In General. The Secretary of Transportation may have new vessels built, and old vessels reconditioned or remodeled, whenever the Secretary decides this is necessary to meet the goals of this subtitle.
(b) Place of Work. This construction, reconditioning, and remodeling must take place at shipyards in the continental United States, including Alaska and Hawaii. But if the Secretary cannot get satisfactory contracts from private shipbuilders, the work may be done in navy yards instead.
(c) Applicability of Construction-Differential Subsidy Provisions. When a private shipbuilder contracts to construct, reconstruct, or recondition a vessel* under this chapter, that contract must follow the same rules that apply to private shipbuilder contracts under title V of the Merchant Marine Act, 1936.
The Secretary of Transportation may have new vessels constructed, and have old vessels reconditioned or remodeled, as the Secretary determines necessary to carry out the objectives of this subtitle.
Construction, reconditioning, and remodeling of vessels under subsection (a) shall take place in shipyards in the continental United States (including Alaska and Hawaii). However, if satisfactory contracts cannot be obtained from private shipbuilders, the Secretary may have the work done in navy yards.
Contracts for the construction, reconstruction, or reconditioning of a vessel* by a private shipbuilder under this chapter are subject to the provisions of title V of the Merchant Marine Act, 1936, applicable to a contract with a private shipbuilder for the construction of a vessel under title V of that Act.
