46 U.S.C. § 70033 — Limitation on application to foreign vessels

Unless an applicable international agreement says otherwise, the listed subchapters do not apply to certain foreign vessels merely passing through United States waters.
Except under a treaty, convention, or agreement binding on the United States, subchapters I–III and this subchapter do not apply to a foreign vessel* that is not going to or leaving a United States port or place and is either (1) making innocent passage through the United States territorial sea or (2) transiting United States navigable waters that form part of an international strait.
Except pursuant to international treaty, convention, or agreement, to which the United States is a party, subchapters I through III and this subchapter shall not apply to any foreign vessel* that is not destined for, or departing from, a port or place subject to the jurisdiction of the United States and that is in—
innocent passage through the territorial sea of the United States; or
transit through the navigable waters of the United States that form a part of an international strait.
