47 U.S.C. § 1403 — Enforcement

(a) General rule. The Commission^* must implement and enforce this chapter as though it were part of the Communications Act of 1934. A violation of this chapter, or of a regulation issued under it, is treated respectively as a violation of the Communications Act of 1934 or of a regulation issued under that Act.

(b) Exceptions. (1) Other agencies. Subsection (a) does not apply to a provision that expressly must be carried out by an agency, as “agency” is defined in section 551 of title 5, other than the Commission. (2) NTIA^* regulations. The Assistant Secretary^* may issue regulations needed to implement and enforce a provision that expressly must be carried out by the Assistant Secretary.
