49 U.S.C. § 115 — Transportation Security Oversight Board

(a) In General — A board called the "Transportation Security Oversight Board" is created inside the Department of Homeland Security. (b) Membership — (1) Number and appointment — The Board has 7 members: (A) the Secretary of Homeland Security or their designee; (B) the Secretary of Transportation or their designee; (C) the Attorney General or their designee; (D) the Secretary of Defense or their designee; (E) the Secretary of the Treasury or their designee; (F) the Director of National Intelligence or their designee; and (G) one member the President appoints to represent the National Security Council. (2) Chairperson — The Secretary of Homeland Security chairs the Board. (c) Duties — The Board must: (1) review and either approve or reject any regulation or security directive the TSA Administrator issues under section 114(l)(2), within 30 days of its issuance; (2) help coordinate intelligence, security, and law-enforcement work that affects transportation; (3) help share intelligence, security, and law-enforcement information about transportation among federal agencies and with carriers and other transportation providers, as appropriate; (4) study whether it's technically possible to build a shared database of people who might threaten transportation or national security; (5) review transportation-security plans; and (6) make recommendations to the Administrator based on that review. (d) Quarterly Meetings — The Board must meet at least once every three months. (e) Consideration of Security Information — A majority of the Board can vote to close a meeting to the public. But a meeting must be closed whenever it will discuss classified information, sensitive security information, or information protected under section 40119(b).
