49 U.S.C. § 13304 — Service of process in court proceedings
submitted 31 years ago by Pub. L. 104-88 to r/title-49-TRANSPORTATION · 169 words · no verdicts yet
Motor carriers and brokers must name an agent in every state where they operate. Courts can serve lawsuits on that agent. If no agent is named, courts may serve any of the company's agents there.
(a) Designation of Agent: Any motor carrier* or broker* providing transportation* covered by chapter 135 — including one operating inside the United States* while carrying goods or people between places in a foreign country, or between two different foreign countries — must name an agent, by name and mailing address, in every state* where it operates. Court process in a lawsuit against that carrier* or broker can be served on that agent. The designation must be written and filed with the Department of Transportation, and each state where the carrier operates may also require its own copy filed with it. If a carrier or broker doesn't make this designation, the lawsuit can instead be served on any of its agents in that state.
(b) Change: This designation can be changed at any time, the same way it was originally made.
A motor carrier* or broker* providing transportation* subject to jurisdiction under chapter 135, including a motor carrier* or broker operating within the United States* while providing transportation between places in a foreign country or between a place in one foreign country and a place in another foreign country, shall designate an agent in each State* in which it operates by name and post office address on whom process issued by a court with subject matter jurisdiction may be served in an action brought against that carrier or broker. The designation shall be in writing and filed with the Department of Transportation and each State in which the carrier operates may require that an additional designation be filed with it. If a designation under this subsection is not made, service may be made on any agent of the carrier or broker within that State.
A designation under this section may be changed at any time in the same manner as originally made.
