49 U.S.C. § 13903 — Registration of freight forwarders

(a) In general: The Secretary must register a person to provide freight-forwarder service under subchapter III of chapter 135, if the Secretary decides the person (1) has enough experience to act as a freight forwarder, and (2) is fit, willing, and able to provide the service and follow this part and the Secretary's regulations. (b) Duration: A registration under (a) only stays in effect while the freight forwarder keeps meeting section 13906(c). (c) Experience or Training Requirement: Each freight forwarder must employ, as an officer, someone who either (1) has at least 3 years of relevant experience, or (2) gives the Secretary satisfactory proof of knowing the related rules, regulations, and industry practices. (d) Registration as Motor Carrier Required: A freight forwarder can't also provide transportation as a motor carrier unless it separately registers to do so under this chapter. (e) Update of Registration: The Secretary must require a freight forwarder to update its registration within 30 days of a change in its address, other contact information, officers, process agent, or other key information the Secretary identifies.
