New or restarting passenger rail services must submit a safety validation plan before carrying passengers. The plan must include safety milestones and a simulated test period. Service can't begin until the railroad finishes everything the plan requires.
(a) Plan Submission. Any railroad starting new regular intercity or commuter passenger service, extending existing service, or restarting service that's been paused more than 180 days must submit a full pre-revenue service safety validation plan to the Secretary of Transportation at least 60 days before starting. The plan must include key safety milestones and a minimum period of simulated revenue service, to make sure operations are ready and all safety-sensitive staff are trained and qualified.
(b) Compliance. Once submitted, the railroad must follow its plan and can't change it without telling the Secretary about the proposed change first. The railroad can't begin actual revenue service until it has completed everything in the plan, including the minimum simulated-service period.
(c) Rulemaking. The Secretary must issue rules to carry out this section, including requiring that any safety problems found be fixed before service starts, and setting deadlines so the Secretary can review and approve plans without causing needless delay.
Any railroad providing new, regularly scheduled, intercity or commuter rail passenger transportation, an extension of existing service, or a renewal of service that has been discontinued for more than 180 days shall develop and submit for review a comprehensive pre-revenue service safety validation plan to the Secretary of Transportation not later than 60 days before initiating such revenue service. Such plan shall include pertinent safety milestones and a minimum period of simulated revenue service to ensure operational readiness and that all safety sensitive personnel are properly trained and qualified.
After submitting a plan pursuant to subsection (a), the railroad shall adopt and comply with such plan and may not amend the plan without first notifying the Secretary of the proposed amendment. Revenue service may not begin until the railroad has completed the requirements of its plan, including the minimum simulated service period required by the plan.
The Secretary shall promulgate regulations to carry out this section, including—
requiring that any identified safety deficiencies be addressed and corrected before the initiation of revenue service; and
establishing appropriate deadlines to enable the Secretary to review and approve the pre-revenue service safety validation plan to ensure that service is not unduly delayed.
