Each State may prepare and maintain its own State rail plan. The Secretary sets minimum requirements, including naming an authority to run the plan and an authority to approve it. States must submit their plan for review and update it at least every four years.
(a) In General. Each State can create and maintain a State rail plan, following the rules in this chapter.
(b) Requirements. The Secretary must set the minimum requirements for making and regularly updating a State rail plan. Under these requirements, a State must do four things: name or create a State rail transportation authority to prepare, maintain, coordinate, and run the plan; name or create a separate authority to approve the plan; send the State's approved plan to the Secretary of Transportation for review; and revise and resend an approved plan for acceptance at least once every four years.
Each State may prepare and maintain a State rail plan in accordance with the provisions of this chapter.
The Secretary shall establish the minimum requirements for the preparation and periodic revision of a State rail plan, including that a State shall—
establish or designate a State rail transportation authority to prepare, maintain, coordinate, and administer the plan;
establish or designate a State rail plan approval authority to approve the plan;
submit the State’s approved plan to the Secretary of Transportation for review; and
revise and resubmit a State-approved plan no less frequently than once every 4 years for acceptance by the Secretary.
