49 U.S.C. § 22903 — Project management oversight

(a) Project Management Plan Requirements. To get federal financial help for a major capital project under this chapter, an applicant must write and carry out a project management plan that the Secretary of Transportation approves. That plan must cover twelve things: (1) enough recipient staff, with clear reporting lines, job responsibilities, job descriptions, and qualifications; (2) a budget covering the project management team, consultants, buying property, moving utilities, testing staff, audits, and other costs the recipient can justify; (3) a construction schedule; (4) a system for controlling documents and keeping records; (5) a documented, organized way of handling construction change orders; (6) the organizational structure, management skills, and staffing needed throughout construction; (7) quality control and quality assurance steps for construction, installing systems, and fitting components together; (8) policies and procedures for testing materials; (9) internal rules for carrying out and reporting on the plan; (10) rules and procedures for testing the finished system or its major parts; (11) regular updates to the plan, especially about budget, schedule, financing, and expected ridership; and (12) a promise from the recipient to regularly send the Secretary its project budget and schedule. (b) Repealed. This subsection was repealed by a 2015 law (Public Law 114–94). (c) Access to Sites and Records. Every recipient of assistance under this chapter must give the Secretary, and any contractor the Secretary hires, access to its construction sites and records whenever that access is reasonably necessary.
