This law lets the Secretary of Transportation hire staff and pay them outside the usual civil-service rules. The Secretary can also contract with outside people for research and reports. Members of the chapter's advisory committee count as special federal employees under a specific ethics law.
(a) General authority. To carry out this chapter, the Secretary of Transportation may (1) hire employees and set their pay without following the normal civil-service appointment rules in title 5, and outside the usual hiring and pay-grade limits in chapter 51 and part of chapter 53 of title 5; and (2) contract with outside people to do research and write reports.
(b) Status of advisory committee members. A person who serves on an advisory committee appointed under section 325 to help carry out this chapter counts as a "special United States Government employee" under chapter 11 of title 18. That status brings certain federal ethics rules that apply to special government employees.
In carrying out this chapter, the Secretary of Transportation may—
appoint and fix the pay of employees without regard to the provisions of title 5 governing appointment in the competitive service and chapter 51 and subchapter III of chapter 53 of title 5; and
make contracts with persons for research and preparation of reports.
A member of an advisory committee appointed under section 325 of this title to carry out this chapter is a special United States Government employee under chapter 11 of title 18.
